1. Acceptance of Terms
By booking, accessing, or using the transportation services (“Services”) provided by Timmins Taxi Services Ltd. (“Company,” “we,” “us,” or “our”), you (“Customer,” “you,” “your,” or “passenger”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, you may not use our Services.
2. Services Provided
Timmins Taxi Services Ltd. provides pre-arranged and hailed point-to-point passenger transportation within the City of Timmins and surrounding areas as agreed upon at the time of booking.
3. Booking and Reservations
Fares and Estimates: Fares are calculated based on a combination of distance traveled and time (metered rate), unless a flat rate is quoted and agreed upon for a specific trip prior to departure. All quoted estimates are subject to change due to traffic, road conditions, weather, or route changes requested by the passenger.
Waiting Time: A waiting time fee may be applied after an initial grace period (e.g., 2-3 minutes) following the driver’s arrival at the pickup location.
Payment Methods: We accept cash, and major credit/debit cards. Payment is due upon completion of the trip unless prior commercial account arrangements have been made and approved in writing by the Company.
Cancellations: To avoid a cancellation fee, please cancel your booking with reasonable notice (e.g., at least 15 minutes prior to the scheduled pickup time for pre-booked rides). Repeated cancellations may result in restricted access to our Services.
4. Passenger Responsibilities and Conduct
For your safety and the safety of our drivers, you agree to the following:
Provide Accurate Information: You must provide the correct pickup location, destination, and number of passengers when booking.
Seatbelts: All passengers are required by law to wear seatbelts when available.
Conduct: You must behave in a lawful, non-disruptive, and respectful manner. The driver has the right to refuse service or terminate a trip immediately if a passenger:
Is under the influence of drugs or alcohol to a degree that they may pose a risk to themselves, the driver, or the vehicle.
Engages in violent, abusive, harassing, or excessively disruptive behavior.
Smokes, vapes, or consumes alcohol within the vehicle.
Causes damage to the vehicle (you will be liable for all cleaning and repair costs).
Is unable to provide a valid form of payment upon completion of the trip.
Personal Property: The Company is not responsible for any personal property left in the vehicle. Every effort will be made to return lost items if they are found and reported. A fee may be charged for the return of items.
5. Driver’s Rights
The driver has the absolute right to:
Refuse service to any person who is intoxicated, under the influence of drugs, or behaving in a manner that is unlawful or poses a safety risk.
Refuse to transport a number of passengers that exceeds the vehicle’s legal capacity.
Determine the safest and most efficient route to the destination, considering current road conditions.
Terminate the trip immediately if a passenger violates these Terms.
6. Liability
Timeliness: While we strive to be on time, the Company is not liable for delays or failures in performance resulting from conditions beyond our reasonable control, including but not limited to weather, road closures, traffic accidents, and acts of God.
Personal Property: As stated above, the Company is not liable for lost, stolen, or damaged personal property.
Injury: To the fullest extent permitted by law, the Company’s liability for any loss, damage, or injury arising from the use of our Services is limited to the amount of the fare paid for the trip in question.
7. Children and Booster Seats
It is the responsibility of the accompanying adult to ensure all children are secured in a manner compliant with Ontario’s Highway Traffic Act.
Passengers are responsible for providing their own provincially approved child car seats or booster seats. Drivers may assist in securing them but are not responsible for their provision or correct installation.
8. Service Animals
Timmins Taxi Services Ltd. complies fully with all applicable human rights legislation. Drivers will transport passengers with service animals without denial or inconvenience. No extra charges will be applied.
9. Changes to Terms
We reserve the right to modify these Terms at any time. The most current version will be posted on our website (if applicable) or available upon request. Continued use of our Services after any changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
